Lydd Airport – Terms & Conditions of Use

1. Definitions

  1.1 “THE AIRPORT” means the entire area of Lydd Airport as defined in CAA Aerodrome Licence P858, as well as any land which is under the control of the company. The term “Airport” shall be interchangeable with the terms “airfield”, “airstrip”, “aerodrome”, or any other similar term where the context so dictates. 

  1.2 “THE COMPANY” shall mean Lydd Airport Ltd.

  1.3 “THE OPERATOR” shall mean the person or organisation entitled to the management or possession of an aircraft including, but not limited to, the owner, user, agent, pilot, captain and shall mean the person(s) or organisation using, attempting to make use of, or having used, the facilities or services offered by the Company at the Airport.

  1.4 “USERS” shall mean anyone not defined as an operator, but still making use of the Airport and its facilities.

  1.5 “THE CONDITIONS” shall mean these Terms and Conditions of Lydd Airport, any Airport Bylaws, and any Rules and Regulations to the use of the Airport, as well as any instructions issued on behalf of the Airport. In the event of inconsistency, and so far as permitted by law, these conditions shall be constructed in all respects according to English Law. 

  1.6 “AUTHORISED AIRPORT STAFF” shall mean any employee of the Airport in the position of CEO, Senior Manager, Manager, or their designated deputy.

2. Scope and Application

  2.1 These Terms and Conditions apply to all aircraft, operators pilots, passengers, crew, contractors, visitors and any other person using, attempting to use, or present at the Airport.

  2.2 These Terms and Conditions apply to all movements, activities and use of the facilities at the Airport, whether airborne, on the ground, airside or landside, and whether or not a formal agreement exists with the Airport.

  2.3 These Terms and Conditions sit alongside, and do not replace, any separate agreements, licences or contracts issued by the Airport.

3. Conditions to the use of the Airport and facilities

  3.1 The use of the Airport by the Operator is subject to the conditions, which shall apply equally to the provision of all facilities or services provided or offered to be provided by the Company.

  3.2 The Company shall be entitled to vary the conditions from time to time, at its discretion and as it sees fit. Provided such variations have been brought to the notice of the Operator or are deemed to have been brought to his notice, such variations shall be binding on the Operator.

  3.3 Use of the Airport is strictly on a PPR (Prior Permission Required) basis and approval for use of defined in the UK Rules of the Air Regulations.

  3.4 Information regarding use of the Airport can be found in the UK AIP entry for Lydd EGMD. Additional information may be promulgated by NOTAM or another appropriate manner.

  3.5 Authorised Airport Staff may at any time require an aircraft operator either to move a parked aircraft to another position or remove it from the Airport for operational reasons.

  3.6 All areas, including waste storage areas must at all times be kept litter free. Fixed or temporary waste storage areas must not present a FOD risk or any other hazard to aircraft. The external storage of goods whether waste or consumable must at all times be contained as to prevent those goods being displaced in adverse weather conditions. The locations of any temporary stores or structures must not interfere with or restrict in any way fire escapes or other areas deemed as entry/exit routes from any building, car park, path or other area requiring access.

  3.7 Users and Operators shall comply with:

     3.7.1 Published aeronautical information including the UK AIP and NOTAMs

     3.7.2 Local procedures and requirements published by the Airport

     3.7.3 Instructions issued by Air Traffic Control or Authorised Airport Staff

     3.7.4 All applicable aviation legislation and CAA requirements

  3.8 Operations shall be conducted in a manner that:

     3.8.1 Prioritises safety over convenience.

     3.8.2 Respects other users and operators.

     3.8.3 Minimises unnecessary noise and disturbance to the local environment.

     3.8.4 Avoids obstructing aircraft movement areas, aprons or access routes.

  3.9 The Airport is private property and reserves the right to restrict, suspend, or refuse operators or users where behaviour, conduct or manner of operation is considered unsafe, disruptive, non-compliant, or contrary to the orderly use of the Airport.

4. Fees and Charges

  4.1 A copy of the current list of the fees and charges will be available on request and will be available at the Airport and promulgated in appropriate publications.

  4.2 The publication of the list is without prejudice to the Company’s right to vary from time to time any of its fees or charges in any way it sees fit.

  4.3 The displayed charges are payable unless otherwise agreed in writing by the Airport.

  4.4 Charges are payable when incurred and, unless credit facilities have been formally agreed, must be settled before departure.

  4.5 The Airport reserves the right to withhold services, including the ability to depart, where charges remain outstanding or disputed.

  4.6 All Fees and Charges are based on the weight of the aircraft as published in the UK CAA Register of Aircraft. In the event of the aircraft being foreign registered, the Company reserves the right to select an aircraft of the same type on the CAA Register of Aircraft to base the Fees and Charges upon.

  4.7 The Operator shall pay interest on any sum outstanding to the Airport should the payment remain unpaid in excess of the 7th day after delivery of the invoice to the Operator.

5. Insurance

  5.1 Each aircraft making use of the Airport (including, but not limited to, landing, take off, touch and go, parking, and hangarage) shall ensure a minimum liability of £5,000,000 any one claim with a reputable insurance company in accordance with the applicable legislation.

  5.2 The Airport may request evidence of insurance when considered necessary.

  5.3 Responsibility for appropriate insurance rests with the Operator.

  5.4 Where the Operator or any person on their behalf or for whom they are responsible causes death, personal injury or loss of damage of any kind whether direct or indirect as a result of any negligence, breach of contract, or breach of statutory duty and while at the Airport, the Operator shall indemnify and keep indemnified the Company in respect of any claim or claims arising.

6. Penalties, Liabilities and Variations

  6.1 The Company reserves the right to apply a penalty for any violation of the Terms and Conditions when it considers such a sanction is warranted. Such a penalty shall normally be in the form of temporary or permanent suspension from operating at or accessing the Airport.

  6.2 The Company is not liable for any loss of earnings of an Operator as a direct or indirect result of a penalty being applied.

  6.3 The Company is not liable for any loss of earnings of an Operator as a direct or indirect result of operational requirements of the Airport at any time.

  6.4 The Company reserves the right at its absolute discretion the ability to waive, vary or release all or any of these Terms and Conditions as it sees fit and without notice.
